Privacy Policy

Introduction to Policy

Bloom Sensory is committed to protecting the privacy and confidentiality of all clients and families who engage with our services. We adhere to all relevant National and Victorian privacy legislation, including:

  • Privacy Act 1988 (Cth)

  • Australian Privacy Principles (APPs)

  • Health Records Act 2001 (Vic)

  • The NDIS Practice Standards and Quality and Safeguarding Framework.

  • Victorian Child Information Sharing Scheme (CISS)

  • Family Violence Information Sharing Scheme (FVISS)

All employees and clients of Bloom Sensory are provided with a copy of our Privacy Policy at the time of their onboarding.

We ensure that all staff and/or volunteers are inducted and aware of their obligations in maintaining client privacy and confidentiality to ensure:

  • Privacy and confidentiality for all clients and employees is maintained when discussing personal or sensitive information. Employees are to remain mindful of where therapeutic discussions take place to ensure confidentiality.

  • Only necessary information for the delivery of therapeutic and support services is to be collected.

  • Maintenance of accurate and up-to-date records at all times, allowing families to correct any out of date or incorrect information provided.

  • Employees are aware that families may withdraw or amend their consent given at any moment.

 

Collection of personal information

What information is collected:

Bloom Sensory will only collect personal and sensitive information that is necessary for the provision of occupational therapy services to children and their families. This information may include but is not limited to names, dates of birth, medical histories, contact details, funding identifiers such as NDIS numbers or Medicare details, referring partner details, and developmental and behavioural information.

Bloom Sensory may also collect sensitive information such as health related information, cultural preferences, sexual orientation, or any other information relevant to service delivery. This information may be obtained directly from families or through referral from external professionals.

Why information is collected:

The information collected is used solely for the purpose of delivering high-quality, safe, and goal-oriented therapy services. This includes but is not limited to, clinical assessments, therapy planning, communication with health professionals, administrative compliance, reporting obligations, legal obligations, and claims processing with funding bodies such as the NDIS or private health insurers.

When information is collected:

Bloom Sensory will collect personal information about clients and their families at the following times:

  • When an initial assessment is booked in

  • During any assessment completed at Bloom Sensory (including but not limited to initial, review, school based and functional capacity assessments).

  • When an online enquiry is completed on our website

  • During the delivery of any therapy or support services.

 

How information is collected:

Bloom Sensory may collect personal information from employees, volunteers or clients and families through the following methods:

  • Paper based forms

  • Online forms

  • Website enquiry

  • Face to face services

  • Telephone calls

  • Emails

  • Social media accounts

  • Referring partners and health professionals

  • Bloom Sensory’s website may use cookies and analytics tools to improve website functionality and user experience. No personal information is collected unless you complete a form or make direct contact.

 

Where information is stored:

All personal information is stored securely using encrypted digital platforms, including cloud-based practice management systems which are protected with two-factor authentication where possible. Access to this information is restricted to Bloom Sensory employees. Further access is limited through role-based permissions.

All personal data is retained in accordance with the Health Records Act 2001 (Vic) and the Archives Act 1983 (Cth) and General Disposal Authorities. This ensures that we store your personal information securely and dispose of this correctly when required.

Consent to collection of personal information

Clients or their legal guardians are required to provide informed consent for the collection, use, and sharing of personal information.

Additional consent is required for the use of photographs of videos to be taken of a client. Photographs and videos may be used for clinical documentation, supervision, or educational purposes only with prior written consent from the parent or guardian.

Separate consent is required for the use of any image or footage for marketing or promotional purposes.

Consent preferences can be updated or withdrawn at any time.

Disclosure of personal information

Bloom Sensory respects the confidentiality of all client information and will only share information with external parties when authorised by the client.

Personal information may be disclosed without consent only in circumstances where there is a legal obligation to do so, such as in cases of suspected abuse, under child protection laws, or when required by a court order.

Bloom Sensory complies with Victorian information-sharing schemes where disclosure is necessary to promote child safety and wellbeing.

In cases where parents are separated, Bloom Sensory will maintain communication with the parent who initiated the service unless legal documentation (such as a parenting order or custody arrangement) specifies otherwise. It is the responsibility of the initiating parent to share relevant information with the other caregivers unless a court directs differently.

Access to personal information

Clients and their legal guardians have the right to request access to the personal information held by Bloom Sensory and to request corrections where the information is inaccurate or incomplete. Requests can be made by contacting us directly.

Complaints

If you believe your privacy has been breached, you are encouraged to raise your concerns with us directly. We take all matters relating to privacy breaches extremely serious and will respond promptly. Employees are aware that breaches in client privacy may result in disciplinary action.

If the matter is not resolved to your satisfaction, you may contact the Office of the Australian Information Commissioner (OAIC) for further assistance.
